BILL OF LADING DESCRIPTION REQUIREMENTS

Adequate Descriptions:
When the commodity description on a bill of lading fails to conform to the
item 360, section 2 of the NMF 100 such that the commodity(s) shipped
cannot be identified, the shipment may be subject to inspection per Tariff
100, Item 364. If the commodity is not identifiable upon immediate,
visual inspection, the carrier reserves the right to use total shipment
density to assign the shipment an NMFC class based on the table below in
order to protect the packaging integrity of the shipment in question. If
the bill of lading lacks a valid commodity description as well as a valid
NMFC class, the shipment may be subject to a minimum class of 175.

Foodstuff or Poison Description Identification:
If the shipper fails to identify the specific commodity or product, the
carrier will not be liable for any damages to or destruction of the
product or commodity resulting from it being on the same trailer with
other freight that is either incompatible or is prohibited by federal,
state, or local laws and regulations from being co-loaded on the same
trailer with the product or commodity improperly described.
i. As shipper, the customer agrees to identify all "Foodstuff(s)",
edible materials, drugs that are ingested, injected
intravenously, or otherwise taken internally when tendered to the
carrier by insertion on the Bill of Lading the word
"Foodstuff(s)".
ii. The customer further agrees as shipper to clearly identify
"Poison(s)" on the bill of lading all shipments containing
materials classified by U.S. Department of Transportation
regulations as "Poison(s)".
iii. As consignee or third party to the shipment, customer agrees to
indemnify carrier if "Foodstuff(s)" or "Poison(s)" are not
identified by the shipper as stated above and carrier will not be
liable for improper loading violations on any shipments where
Foodstuffs or Poisons have not been identified as indicated.
Initials and acronyms are not acceptable.
